Overview of Paternalism Law Term Paper Example | Topics and Well Written Essays - 1250 words

Overview of Paternalism Law - Term Paper Example Several laws and regulations have been enacted that encourage paternalism by the government such as requiring a motorcyclist to wear helmets. These actions by the government have been opposed by several utilitarian thinkers like John Stuart Mill. He is opposed to the actions that led to paternalism by the government based on his autonomy-based argument. Paternalism exists in the form of restrictions or requirements imposed on people to perform in order for the common good to be maintained. In his topic on liberty, Mill argues that the government encourages cyclists to wear helmets to promote a good (Skorupski, 34). The protection of the person from injury is a good that cannot be ignored and it is not that the cyclist does not value his life, but this legislation goes against another good. In relation to the arguments brought forward by Mill, it is reasonable to conclude that Mill supports government actions. The question of self-protection as the basis for justifying paternalism is questionable since an individual is the most qualified person to judge himself/herself. As a result, it true to conclude that an individual is the most interested person in his own well being. ...This is in reference to the fact that Mill argues that no amount of restraint or compulsion by others can stop adults from pursuing their interests. However, in some instances, government interventions do not only restrict a person’s liberty but encourage alternative solutions (Blokland, 78). In relation to paternalism, a person should be an independent and autonomous agent with the ability to choose his freedom. A utilitarian argument passed on by Mill is that of that there comes a time when a person has the discretion of his/her individuality being absolute. However, there are two strains of Mill’s argument with one based on straight forward utilitarian while the other relies, not on the good brought by the free choice but on the supreme value of the choice.

Revolutions and their significance Essay Example | Topics and Well Written Essays - 250 words

Revolutions and their significance - Essay Example liberate forces of production .The first Russian revolution (1917-1918) was a result of public’s demand for a freer inner market and the French revolution (1789-1799) happened because public became frustrated of the ongoing aristocratic scenario. These instances show that it was a particular aspect that provoked the public to revolt. A country’s revolution does not necessarily affect another country since no two governments are alike and so are the problems of its populace. However, the fact cannot be negated that revolutions always induce an everlasting impact on the world because governments learn to mend their ways to avoid similar situation in the region. Alternately, occurrence of revolutions whether in the past or in recent times provokes another nation to stand against injustice and socio-economic imbalance in their country. Revolutions act like processes that force institutions to realize the power of public and alternately these also make public realize its own capability. â€Å"The revolutions in France and Russia liberated the enormous power of social reality of the people, creating powerful images of democratic equality to come† (Foran and Lane et al., 44). In France, not just its society underwent an epic transformation by favoring democracy over aristocracy, the world also grew fond of secularism and liberalism and a rapid rise in democracies and republics was witnessed afterwards. Similarly, 1917 Russian revolution shook the balan ce of powers during World War I and gave the world its first communist state, which as a concept was soon adopted world over and generated many other revolutions. The 1989 Russian revolution resulted in changing history by creating 14 new states and promoting abandoning of communism. Therefore, revolutions are not merely historical incidences or dates but highly impactful reflections of a group of individuals that in-turn produce everlasting impression not only within the society but globally as well. International Politics Essay Example for Free

International Politics Essay Transformation—is one of the few words which could be used in order to define and describe the current situation of the international community. In every parts of the world, transformation is currently occurring from the simple acquisition of one product to another. Such situation could be one of the few examples of the changes which are present in the current society. In the modern society, boundaries and limits had now been erased due to the technology including the issues facing most states in the global community. The past limitation of states in surpassing territorial boundaries of their own state is now removed. Such hindrances are not a concern any longer. The gaps in which divides states are now being linked therefore making each and everyone of us connected. The far away lands of Africa or Europe could now be reached through one click of a button. The then complicated processes of communication as well as the process of international relations had changed due to globalization. The process of globalization became a significant change in the relations of states. In addition, states are not only the actors in the international community. The active participation of non-state actors had been highlighted in the past events which had recently occurred such as wars, conflicts and environmental phenomenon. In the past such as the events of the World War I, nations were the only actors in the war. Decisions were only influenced by the leaders of the states involved. Although international organizations were present in providing aid to the victims of the war, they were not equally involved in the decision making process. But as these events unfold, it is evident that international organizations are similarly participating with the political issues at hand. In the principle of realism, the main actors were only states however; in the view of the liberalism theory, other actors such that of international organizations, trans-national organizations, multinational corporations and the likes. In the book of Baylis and Smith, the authors stated that in â€Å"Realists emphasize states’ ruthlessly self-interested search for territorial, military and economic resources† (Baylis and Smith, 2008). On the other hand, Liberalism or Idealism pursues to promote internationalism during the inter-war period (Baylis and Smith, 2008). The theory of liberalism’s main idea is to attach government together with good governance which will create a connection between states and the societies of the global community. Liberalism promotes the need for the world to unite and commune with the issues of the international community equally. However, unlike the liberalism, realists approach the view of internationalism is translated as anarchy. (Baylis and Smith, 2008) Evidently, the world is already shifting and adopting another form of ideology other than realism which was mainly utilized in the past. In the inter-war years, the liberalist theorists started to promote their perspective in which advocates that international institutions should encourage the values of having order, justice, liberty and toleration within the relationship of states. It was believed in such theory that the conflicts between states could not only be resolved through the use of force and warfare. International institutions or organizations much act as mediators when conflicts are at hand. In addition, such international institutions must be the area of discussion for the reason that it could create other actions in resolving disputes in a much objective manner. Therefore, the liberalists were able to influence every state in creating an international organization which lead to the creation of the League of Nations in which became the fundamental foundation of the United Nations. Although the ideas of the liberalists were idealistic, each state must be a member of the organization in order to fully accomplish and pursue the goals of the international organization. (Baylis and Smith, 2008) In our changing world, the past conflicts and issues of a state are realized to also be affecting the world. The recent war on terror had been actively participated by different states in order to deter the effects of terrorism. After the war on terror, many states changes their view point which such situations—following the chief state which proclaimed the war. The war on terror became a global issue due to the involvement of different states. Additionally, international organizations became a great factor in such war. The war in Afghanistan for example, the United Nations became one of the main decision maker and supporter of the war. The United Nations launched protocols and written agendas in order to promote action against the cruel ruling and the storage of the weapons of mass destruction of Saddam Hussein. In the incident given, the United Nations played a great role in encouraging and promoting in the issue against terrorism. United Nations became one of the main actors is countering against terrorism unlike in the past. (Bredel, 2003) Another issue which is currently in debate until this day is the issues concerning the global environment—climate change. This issue is one of the most controversial and debated issues because it is one of the problems of the world which passes the boundaries of states. Climate change not only affects the climate and the environment but also the politics and economics of each state. One of the few very specific problems under climate change is pollution. Pollution had been a great problem for different states for the reason that it encompasses the boundaries of states. It is known that most industries or factory excretes smoke which turns out to be air pollutants due to the machineries used to create products and the likes. Water pollution also has the same situation for the reason that it flows although out different forms of water and continuously flow to the water of other states. The problem obviously passes through the limitation of the international law and protocols available. The problem becomes a trans-national issue that requires states to cooperate and coordinate with each other in order to solve such crisis. With the issue of climate change, trans-national entities are the most reliable organizations in laying down such issues. Trans-national organizations provide states a much immediate and larger picture of the issue. Due to the personality of trans-national organization, different organizations that aim for the same goals as others come together to be able to solve the dilemmas at hand. With the issue of climate change, the main agent which is very much focused is the United Nations. The international organization created a branch which focuses on the issues of environment which is the United Nations Environment Programme (UNEP). The branch of United Nations provides answer to the needs of each state in order to address the problem. The UNEP together with the states and other organizations with the same advocacy such as Green Peace and other local organizations with in the various states to be able to provide answer to the issue. The role of non-state actors and trans-national networks had become significant in the international community due to the promotion of international organization during crisis. The power given to non-state actors as well as trans-national networks enable these agencies to freely interfere with the conflicts of states and within states. Therefore, these groups provide their own view points, influencing states and individuals with their perspective. Most of the time, such organizations changes the civil society which then results to the change of the government. One example that could be cited is the pursuance of NGOs (Non-Governmental Organizations) in Asia to promote change in the civil society, therefore promoting development within the society. It is stated by Harriet Bulkeley and Michele Merrill Betsill (2005) in their book that â€Å"the international, regional, national and local interact â€Å"with actors influencing the activities of different levels simultaneously† (cited in O’ Riordan and Jordan 1996). With the statement given by the authors, it is evident that the role of non-state actors as well as trans-national organization is equally important as the responsibility of states. Therefore, the international order is changed due to the additional actors that are also acting in the international community. Currently, the international community is evidently reliant to non-state actors as well as to the trans-national networks due to the important role that it is undertaking with conflicts and decision making processes of a state. Non-state actors and trans-national networks had become one of the main components of international relations whether it may be in conflict resolution or in times of celebration. Such groups empower and support positive ideology due to the idealistic nature of most non-state and trans-national networks. The usual â€Å"state-only† theory had now been changed into a new form of relations of states which brings together actors that has the same goals to attain making the relations of states peaceful. Although most non-state actors and trans-national networks aims to create a united international community, there are also groups alike that promotes otherwise. One well known group is the Al-Qaeda which seeks to promote terror and violence from the eyes of most states. Although Al-Qaeda is seen as an extremist group in promoting change, it is also considered a trans-national network for the reason that it encompasses the boundaries of its home state and promotes their ideology to the world. The group creates networks in different parts of the world while maintaining a balance relation with other networks associated to the group. Due to the negative effects they such trans-national network is creating; it definitely changes the order of the international community. Not only it brings terror to the whole global community but the group promotes division and conflict within the global society. (Pearlstein, 2004) In conclusion, the issues that the international community is facing are now crossing the boundaries of states such that of the terrorism and climate change. There is a need for states to get together and resolve such dilemma. Therefore, trans-national networks and non-state actors play a vital role in resolving such problems. The non-state and trans-national networks are the best area for the resolution of such conflicts because objectiveness within the situation is achieved. The international community sets the non-states actors and trans-national networks as the one of the numerous vital actors in the global community. The participation of such actors promotes the unity of the whole international community in times of crisis or triumph. References Baylis J. , Smith S. , Owens, P. Eds.(2008). Motorola is a company that has been around a long time and one of its main key factors to success is that that you can see the brand name any where you go. Motorola is the second leading producer of wireless handsets and is the top supplier of wireless infrastructure equipment such as cellular transmissions base stations, amplifiers, and network switching. Its also helpful in many new products such as the new Star Tac cell phone that has the market wondering if Motorola is back in the game and ready to regain market share. Motorola is also the top producer of fixed chips that are used in wireless networking, automotive, and customer products. A key success for many annalists is how much market share a company has. Motorola has the no. one global market share in semiconductors for automotive applications, in communications processors, and in radio frequency power products for cellular base station markets. CONCLUSION AND RECOMMENDATIONS To remain competitive in these extremely competitive economic situations that exist in todays telecommunication industry, telecommunication companies must look for excellence. New style of management helps in achieving the excellence which focuses on cycle time reduction, employee involvement, the reduction of waste, continuous improvement, and customer satisfaction. To gain competitive edge in twenty first century market, it is crucial for telecommunication companies to supply more reliable quality and value to their customers. It is the time to expand better and more direct relationships with clients, to start teamwork at the jobsite, and to generate better quality work. The recommendations are that Motorola must continue to sustain the position of cost leadership by focusing on quality of the products, as it helps in producing high volumes of mature products, which lead to lower prices. Motorola should apply differentiation strategy to gain competitive advantage to charge premium prices.

The Feminine Religious Experience in Victorian Times Essay -- Victoria

The Feminine Religious Experience: Beyond the â€Å"Angel in the House† The conception of the Victorian woman as the pious repository for her family's stockpile of religiosity consistently permeates contemporary notions of the gender roles of the era. However, the idealized role of the â€Å"angel in the house† was often simply that - an ideal rather than a reality. Women's involvement in religion and spirituality varied widely based on class and level of devotion. Though the majority of women's religious duty consisted of assisting charitable works sponsored by parishes (Heeney 330), women were also employed as local missionaries. The era also witnessed the revival of the convent as an alternative avenue for women of all classes. For the Victorian-era upper middle class family of the Pagets of London, the women received a Christian education in terms of learning the Bible and reciting psalms. In adulthood they fulfilled their Christian duty by volunteering for and donating to various charities for the poor and/or feeble-minded (Peterson 692) However, the private letters of the Paget women often indicate that their helping the poor was not inspired by an altruistic love of all God's creatures, as the â€Å"angel the house† myth would lead one to believe. Instead these were societal obligations, on par with social calls to friends: Catherine Paget wrote â€Å"I spent the morning seeing poor people, the afternoon calling on rich ones.† (Peterson 706) Lydia Paget also wrote, â€Å"†¦I always go with such reluctance to visit the poor people under our care; when I once get amongst them I quite enjoy myself, but on setting out I feel inclined to bend my steps in any other direction rather than th e right.† (Peterson 706) Beyond charity work, women also... ...t beyond embodying the moral and spiritual core of the family. Comparing T.S. Eliot and Charles Dickins :: essays papers

Comparing TS Eliot and Charles Dickins The poetry written by Thomas Stearns Eliot, Portrait of a Lady has a strong connection with the novel by Henry James. Both deal with almost the same issues. In the poem Eliot talks about how a person will live his or her life during the 19th century. How they would always do exactly what was considered right during that era in society. Eliot mention how rare and strange it is to find true friends. In the novel everyone pretend to be your best friend and was only using the person to benefit something for his or her own convections (Lozano, 2). You do not know how much they mean to me, My friends, and how, How rare and strange it is, to find In a life composed so much, So much of odds and ends (Eliot 19-21). Many people during the 19th century really made friends so that they can have more people coming to their tea parties, one of the things that are mention in the poem as well as in the novel (Lozano, 3). Isabel Archer was considered to be a very innocent lady; she was being taken advantage so that others can get what they wanted when all she wanted was a real friend. Madame Merle was a clever woman who used her to get money for her daughter (Henry, 181). Repeatedly saying in this poem that he will serve tea to his â€Å"friends†. He is saying that in this era there was no such thing as a real friend even though everyone wanted one of his or her own. For everybody said so, all our friends, They all were sure our feelings would relate So closely! I myself can hardly understand. We must leave it now to fate.

World War Ii And Adolf Hitler

Adolf Hitler was born on April 20, 1889 in the small town of Braunau Am Inn in Austria. His parents were Customs official, Klara and Alois Hitler. He became a German politician and went on to be the head of the National Socialist German Workers Party or better known as the Nazi Party. From 1933 to 1945 he held the position as Chancellor of Germany and ruled the country in a dictatorship manner. He was a known veteran of the First World War and he joined the pioneer of the Nazi Party (DAP) in 1919 and went on to become leader of the NSDAP by the year 1921. In 1923, Hitler led a failed coup in Munich known as the Beer Hall Putsch. He was imprisoned because of such attempt and it was that time that he wrote his book.He acquired support from his writing as he promoted anti-Semitism, German nationalism, anti-communism, and anti-capitalism with compelling rhetoric and propaganda. In 1933, he became chancellor and transformed Germany into a single-party dictatorship founded on the despotic a s well as tyrannical principles of National Socialism.Hitler’s actions and policies led to the declaration of France and United Kingdom of war against the country. This led to the outbreak of the Second World War in Europe. Because of the Nazi Regime of Hitler and his genocidal policy, about 11 million people were killed and more than 6 million Jews were annihilated throughout the Holocaust. For three years Germany together with the Axis powers had conquered most of Northern Africa, East as well as Southeast Asia, and Europe with Hitler being a major key player. Hitler and his mistress got married as the days of war came to an end and they both committed suicide.World War I eraDuring the 16th Bavarian Reserve Regiment, Adolf Hitler served Belgium and France. He became a Gefreiter by the end of the war (a private first class in terms of the American armies and a lance corporal in British terms). He was frequently exposed to the adversary’s fire as he served as a runner o n the Western Front. He was a participant of some of the most important battles of the West including the First Battle of Ypres, Battle of Arras, Battle of the Somme, as well as the Battle of Passchendaele.[1]In October 1914, the Battle of Ypress took place which was known in Germany as the Massacre of the Innocents having about 40,000 killed in a span of 20 days and even the infantry division that Hitler belonged to lost about 200 men by December that year. This incident made Hitler become withdrawn and detached as the war continued. Adolf Hitler was recognized for the bravery he had shown during the years of war. In 1914, he got the Iron Cross, Second Class, recognition, and 4 years later the Iron Cross, First Class. These are honors not often given to someone of his rank (Gefreiter).  Early years in powerAdolf Hitler’s power and glory began in September 1919 when he became a member of DAP or Deutsche Arbeiterpartei which later on became more popularly known as the Nazi par ty. The party was an anti-Marxist and was formed throughout the aftermath of the World War I period. His rose to power began in the initial years of the Nazi party from 1919-1923 due to his substantial skills in promotion, organization, and public speaking.[2]Germany was consistently aggressive during the World War I for more than four years (1914-1918). After the First World War, Hitler went back to Munich. For the period of 1918-1919 he was on a steady but comparatively insignificant assignment but he was in due course enlisted by the Army’s Political Department. His great skills in public speaking and his open and intense anti-Semitism impressed an army officer and gave him a promotion making him an education officer. This gave him more opportunities to give public speeches which greatly contributed to his acquisition of power. In one meeting, Hitler again used his tremendous skills in oratory impressing Anton Drexler, the DAP (Deutsche Arbeiterpartei) founder. He gave Hitle r a political pamphlet and later on invited him to be a member of their party. Hitler attended the committee meeting that was part of the invitation. His initial thoughts were that the party was too disorganized and mixed-up.Their membership process was messed up and this led Hitler to a consideration that he could be of great influence to the party as it was not totally established. Two days after that particular meeting, he decided to become a member of DAP, making him the 55th member. Adolf Hitler was named to be the leader of propaganda by 1920 because of his talents that were recognized by the heads of the party.[3]On February 20, the party became known as Nationalsozialistische Deutsche Arbeiterpartei or NSDAP and Hitler began to transform it. By July 28, 1921, Hitler became in full control of the party ousting Drexler.Hitler’s aggression was brought to the party. They disrupted meetings of their â€Å"opponents†, caused chaos & disturbance, causing the imprisonm ent of Hitler for some months. Hitler also began to form two organizations between 1922 and 1923.These are Jungstum and Jugendubnd, two unions that are bound to have great importance. Because of Hitler’s continuous rebellion, Hitler was convicted and imprisoned for five years. In prison, he began to contemplate about a lot of things particularly his political tactics. It was during this time that he was able to write his first book entitled Mein Kampf or My Struggle.[4]Adolf Hitler was released on December 20, 1924 from prison and assured that he would continue to get hold of political power but this time only by lawful and constitutional ways or means. The Nazi Party during the May 1928 German elections only gained an overall vote of 2.63% of 810,127 votes.[5] Because of these results, Adolf Hitler was determined to spread the goals of their party to the German people. He felt that the Germans weren’t fully aware of their party’s objectives and aims.Hitler wrote his second book in order to lay out the word of the Nazi party. By the end of that year, the Nazi party has about 130,000 members and the following year, the Nazi party had a representative to the Presidential elections by the name of Erich Ludendorff. Ludendorff got 1.1% of the total votes or 280,000 total votes.[6] He was the lone aspirant to gain fewer than a million votes. The street fights grew extremely brutal and violent. After the Rotfront (Communist party) interrupted Hitler’s speech the SA (Storm battalion or division) went into the streets and executed two spectators. The SA on August 25, 1928, crashed a Rotfront gathering, as the tension between the two groups continued to heat up. The battle between the two went on for the following years resulting to more political violence and deaths. The Nazi party had never been a power player in Germany’s election as they were only the 9th smallest party before the Great Depression hit the country in 1930.The new Chanc ellor then, Heinrich Brà ¼ning, coming from the Roman Catholic Centre Party, slowly but surely lost the majority in the parliament, thus the Brà ¼ning administration needed to use the president’s emergency decrees. A premature election in September 1930 paved the way for the Nazi party to garner 18% of the vote equivalent to 108 seats in the parliament, making them second to the largest party in the chamber.[7]Hitler meant to run as president in the scheduled elections against President Pal Von Hindenburg, only with one problem. Hitler was Austrian born and still had not acquired German citizenship, not until the 25th of February as the interior minister of the Brunswick appointed Hitler as administrator for the state’s delegation making him a citizen of Brunswick. Their effort was not enough to win, but it showed that Hitler is a possible choice in German politics. The president, after heavy thinking, reluctantly appointed Hitler Chancellor of the coalition governmen t materialized by both NSDAP and DNVP. Still with the appointment of Papen as Vice-Chancellor and other conservative cabinet, the Nazis are contained to their framework. Hitler stopped any attempts by his adversaries to form a majority body in the parliament.Hitler planned to dissolve Reichstag once again and there was a scheduled election for March, but February 27, 1933 came, and the Reichstag building was set ablaze.[8] A Dutch independent communist was the victim to this incident and the government reacted by suspending basic rights, habeas corpus included, to blame the fire to communists. The Nazis maximized their opportunity as campaigns continued, using anti-communist propaganda & paramilitary violence. The NSDAP garnered 43.9% of the votes during Election Day, March 6, to remain the largest party in the nation. But still without having absolute majority, their victory was blemished, as they need to maintain a coalition with the DNVP.[9]Hitler eagerly met with the newly-electe d Reichstag with an act that would give the cabinet (and of course Hitler himself) legislative powers for a period of four years. The Enabling Act would allow deviation from the constitution but only after winning 2/3 majority in the Reichstag. Thus, the government needed some help of other parties for the votes. The Centre Party would prove to be the deciding element as they carried the Enabling Act. In return, the government guaranteed the Church’s liberty and the existence of the Party, through oral assurances. With this in motion, the Enabling Act was agreed upon by every party except the Social Democrats on March 23rd, and in combination with the Reichstag Fire Decree legally transformed Hitler’s government as dictatorship. Now having both legislative and executive power, Hitler finished off the opposition. The Social Democratic Party, SDP, was marked off illegal and other parties were forced into dissolving. After only less than 4 months, July the 14th, the Nazi Par ty was declared the â€Å"only legal party† in Germany. All notable opposition to Hitler was one by one murdered. And with the death of the President Pal von Hindenburg, Hitler’s cabinet, capitalizing on the moment, passed a law transferring the role and power of the President to Hitler. Although with major inconsistencies with the constitution, and technicality that barred Hitler for making any actions with regards to the Presidency, no one dared to object. With the Presidency finally on his hands, Hitler was now the most powerful man in Germany.Being the Head of State, Hitler became the Supreme commander of the Armed Forces, and instead of the soldiers and sailors doing the traditional loyalty oath, it turned to an oath of personal loyalty to Hitler.[10] Hitler then forced his War Minister Werner von Blomberg after evidences that his new wife had a criminal past; this was prior to removing several positions in the Armed Forces. But to the surprise by many, Hitler, anno unced that he will be assuming the command of the Armed Forces, taking over Blomberg’s old post – being the Commander – in – chief of the Armed Forces, giving Hitler the ultimate power in Germany.
